Prendre garde aux modalit\u00e9s de fixation du tarif h\u00e9bergement dans le CPOM\n<\/span>\n\t\t\t\t\t\t\t<\/h2>\n\n\t\t\t\n\t\t\t\t\t\t<div class=\"uael-module-content uael-separator-parent\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"uael-separator\"><\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\t\t\t\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a0acbfb elementor-widget elementor-widget-text-editor\" data-id=\"a0acbfb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Attention, pour commencer, \u00e0 la fa\u00e7on dont vont \u00eatre fix\u00e9s le tarif h\u00e9bergement et ses modalit\u00e9s d\u2019\u00e9volution annuelles dans le CPOM ! Il deviendra difficile de revenir dessus, une fois le CPOM sign\u00e9. Le <a rel=\"noreferrer noopener\" href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000033670895&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">d\u00e9cret tarifaire n\u00b0 2016-1814 du 21 d\u00e9cembre 2016<\/span><\/a><span style=\"font-weight: 400;\"> rend obligatoire la fixation pluriannuelle du tarif h\u00e9bergement dans le cadre du CPOM. Cela implique la n\u00e9cessit\u00e9 de fixer dans le CPOM, avec le d\u00e9partement, les \u00e9l\u00e9ments pluriannuels relatifs \u00e0 ce tarif.<br \/>Les modalit\u00e9s de <strong>revalorisation<\/strong> pluriannuelle de la tarification h\u00e9bergement qui peuvent \u00eatre inscrites dans le CPOM sont limitativement \u00e9num\u00e9r\u00e9es \u00e0 <a rel=\"noreferrer noopener\" href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000033700243&amp;cidTexte=LEGITEXT000006074069&amp;dateTexte=20190528\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">l\u2019article R. 314-40 du CASF<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><\/span><\/p><p>Elles peuvent consister :<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d166266 elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"d166266\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-check\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">En l'application directe d'un objectif annuel ou pluriannuel d'\u00e9volution des d\u00e9penses d\u00e9lib\u00e9r\u00e9 par la collectivit\u00e9 d\u00e9partementale. S\u2019interroger sur son habilitation \u00e0 recevoir des b\u00e9n\u00e9ficiaires de l\u2019aide sociale<\/span>\n\t\t\t\t\t\t\t<\/h2>\n\n\t\t\t\n\t\t\t\t\t\t<div class=\"uael-module-content uael-separator-parent\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"uael-separator\"><\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\t\t\t\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-593a0bc elementor-widget elementor-widget-text-editor\" data-id=\"593a0bc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La conclusion d\u2019un CPOM est un moment propice pour s\u2019interroger sur l\u2019opportunit\u00e9 d\u2019am\u00e9nager son habilitation, ceci dans l\u2019id\u00e9e de d\u00e9gager des marges de man\u0153uvre budg\u00e9taires suppl\u00e9mentaires. Il faut n\u00e9anmoins avoir \u00e0 l\u2019esprit que toute modulation du dispositif d\u2019habilitation va entra\u00eener \u00e0 terme des diff\u00e9rences de prix entre les r\u00e9sidents. Il convient donc d\u2019avoir pris la mesure de cet impact par une \u00e9tude prospective pr\u00e9alable afin de ne pas compromettre le <a href=\"https:\/\/www.gerontim.com\/fr\/prestations\/etude-besoins-opportunites\/\">positionnement strat\u00e9gique de l\u2019EHPAD<\/a> sur son territoire.<br \/>Les moyens permettant de moduler son habilitation \u00e0 recevoir des b\u00e9n\u00e9ficiaires de l\u2019aide sociale sont :<\/p><ul><li><strong>Le conventionnement sur l\u2019aide sociale<\/strong><\/li><\/ul><p style=\"padding-left: 40px;\">Pour les \u00e9tablissements habilit\u00e9s \u00e0 l\u2019aide sociale, le CPOM vaut convention d\u2019aide sociale. La conclusion d\u2019un CPOM conduit donc naturellement \u00e0 s\u2019interroger l\u2019opportunit\u00e9 d\u2019un tel conventionnement. La convention d\u2019aide sociale permet de n\u00e9gocier avec le d\u00e9partement une libert\u00e9 tarifaire sur les places habilit\u00e9es \u00e0 l\u2019aide sociale, mais occup\u00e9es par des r\u00e9sidents payants. Elle emporte \u00e9galement l\u2019application du taux interminist\u00e9riel d\u2019actualisation annuelle des tarifs, ce qui n\u2019est pas d\u00e9nu\u00e9 d\u2019int\u00e9r\u00eat selon les d\u00e9partements.<\/p><ul><li><strong>Le renoncement partiel \u00e0 son habilitation \u00e0 l\u2019aide sociale<\/strong><\/li><\/ul><p style=\"padding-left: 40px;\">Toujours en vue de lib\u00e9raliser le tarif h\u00e9bergement, il est \u00e9galement possible d\u2019envisager le retrait partiel de l\u2019habilitation. Envisager une \u00e9ventuelle modulation de ses tarifs<\/span>\n\t\t\t\t\t\t\t<\/h2>\n\n\t\t\t\n\t\t\t\t\t\t<div class=\"uael-module-content uael-separator-parent\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"uael-separator\"><\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\t\t\t\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cc3b9cd elementor-widget elementor-widget-text-editor\" data-id=\"cc3b9cd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-size: 16px;\">En gardant \u00e0 l\u2019esprit les impacts sur la concurrence et la capacit\u00e9 contributive de la population \u00e2g\u00e9e sur son territoire, il est \u00e9galement possible d\u2019envisager une <strong>modulation<\/strong> de ses tarifs en fonction du standing des chambres ou des prestations offertes.<\/span><\/p><p>Le Code l\u2019action sociale et des familles permet en effet de d\u00e9terminer plusieurs tarifs aff\u00e9rents \u00e0 l\u2019h\u00e9bergement. Il est ainsi possible de moduler ses tarifs afin de tenir compte notamment :<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5b35ec3 elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"5b35ec3\" data-element_type=\"widget\" data-e-type=\"widget\"
